AFFILIATE TERMS AND CONDITIONS (ADULT)

Before your transaction can be completed, you must read and agree to these terms and conditions. By applying for access and or services from this website, you are agreeing to these terms and conditions, and are agreeing to be legally bound by them. This agreement is subject to change by CCBill at any time. Changes are effective when posted on this site without notice upon each subscriber.

1. Legal Definitions

"Member" or "Membership," as referred to in this document shall mean: The subscriber or user of a valid username and password (e-ticket) for the site during the term of membership.

"Site," as referred to in this document shall mean: The website for which you are purchasing a username and password (e-ticket) from CCBill in order to access the site and its materials and obtain the benefits of membership.

"Subscriber," as referred to in this document shall mean: The End-user / Consumer, of the services of the site and holder of a valid username and password (e-ticket) for the site.
"E-ticket," as referred to in this document shall mean: The combination of unique username and password that is used to access a site. An e-ticket is a license to use a site for a period of time that is specified.

"Bookmarking," as referred to in this document shall mean: The act of placing a URL into a temporary file on the subscriber?s browser so that the subscriber may return to that page at a future date directly, without passing through any pages that may have proceeded.

2. Description of Services

CCBill will provide one e-ticket to access the site and its contents for which you are purchasing membership.

3. Billing

CCBill.com will appear on your credit card, bank statement, or phone bill for all charges made. If multiple venues are joined utilizing any payment method, your statement will list each individual purchase comprising the transaction. CCBill may include other information on your statement based on credit card association, telephone regulation, NACHA and any other mandated rules and regulations. If you elect to use your checking account to purchase a subscription to this website, an ACH debit will be drawn on their account. Your agreement with these Terms & Conditions is your approval for CCBill to issue an ACH debit to your account.

4. Payment / Fee

Sites may have periodic subscription fees that are defined by the owners of the site at the time of the initial enrollment for subscription. The member is responsible for such fees according to the terms of the site. Once a member has the ability to access the site using the e-ticket assigned to the member, subscription fees become non-refundable.

5. Automatic Recurring Billing (If Selected By You On The Sign Up Page)

As determined by the content provider of the site, subscription fees may be automatically renewed at the end of the original term selected, for a similar period of time, unless notice is received from the subscriber seven (7) days before renewal. All special introductory offer Members shall be exempt from the 7 day notification requirement, but subscriber must notify CCBill directly 24 hours prior to the end of the trial/special offer period in order to cancel automatic renewal. All trial/special offer memberships shall renew at the stated membership rate. The maximum term of this agreement is 100 months.
Unless and until this agreement is cancelled in accordance with the terms hereof, subscriber hereby authorizes CCBill to charge subscriber's chosen payment method to pay for the ongoing cost of membership. Subscriber hereby further authorizes CCBill to charge subscriber's chosen payment method for any and all additional purchases of services and entertainment provided by the site.

6. Electronic Receipt

Subscribers will receive an email receipt to their email provided upon initial subscription. Subscriber may, at any time, request a copy of the account of charges made for the life of their membership to the site. Subscriber foregoes this right if such request is not made. Requests must be made directly to CCBill. To contact CCBill, refer to the Questions and Contact Information at the end of this document.

7. Cancellation

At any time, and without cause, subscription to the service may be terminated by either CCBill, the site, or the subscriber upon notification of the other by electronic or conventional mail, or by telephone or fax. When the member requests the termination, subscription fees are NOT refunded. Subscribers are liable for charges incurred by them until termination of service.

If you request cancellation or request a refund from CCBill, your bank, card issuer, or phone company due to unauthorized or fraudulent use, CCBill can at its discretion, to prevent further unauthorized use, block your information from use at all CCBill clients? websites. This will not however prevent unauthorized use at non-CCBill clients? websites, and is not a substitution for your contacting your appropriate channels to prevent further misuse.

If you are taking advantage of a ?Free? trial period through a credit card, please be aware of the following: CCBill will request and your bank will immediately put a ?Reserved Funds? hold on your credit card for the amount of the subscription plan you have selected. If the free trial is cancelled within the timeframe allowed by the website, it typically takes the banking system 7 to 10 days to remove the credit card hold from these funds. Please understand that CCBill has no way to remove this hold. During the trial period and for a minimum of 7 to 10 days after you cancel, these funds are considered out of your bank even though technically they are still there, and you could overdraw or exceed the limits of your account. You are responsible for any charges imposed by your credit card issuing bank for exceeding your account limits or overdrawing your account.

8. Refunds

When the member requests the termination, subscription fees are NOT refundable. Should a refund be issued by CCBill, all refunds will be credited solely to the payment method used in the original transaction. CCBill will not issue refunds by cash, check, or to another credit card or payment mechanism.

9. Bookmarking

Subscriber agrees that at any time they will not bookmark any page to the site that will allow the subscriber to bypass the terms and conditions of the site upon entering. If such a bookmark exists, said bookmark will constitute full agreement to said terms and conditions as well as to admission that subscriber is of legal age of majority in their state, country or region.

10. Authorization of Use

Subscribers to the site are hereby authorized a single e-ticket to access the service or material located at this website. This e-ticket shall be granted for sole use to one subscriber. All memberships are provided for personal use and shall not be used for any commercial purposes or by any commercial entities. Commercial use of either the site or any material found within is strictly prohibited unless authorized by the website. No material within the site may be transferred to any other person or entity, whether commercial or non-commercial. In addition, materials may not be modified, or altered. Materials may not be displayed publicly, or used for any rental, sale, or display. Materials shall extend to copyright, trademarks, or other proprietary notices there from.

CCBill and the site reserve the right to terminate this e-ticket at any time if the terms of this agreement are breached. In the case that the terms are breached, you will be required to immediately destroy any information or material printed, downloaded or otherwise copied from the site.

11. Transfer of E-ticket

Access to the site is through a combination of a username and a password (e-ticket). Subscribers may not under any circumstances release their e-ticket to any other person, and are required to keep their e-ticket strictly confidential. CCBill will not release passwords for any reason, to anyone other than the subscriber, except as may be specifically required by law or court order. Unauthorized access to the site is a breach of this Agreement and a violation of law. Subscribers acknowledge that the owner of the site may track through the use of special software each subscriber?s entry to the site.
If any breach of security, theft or loss of e-ticket, or unauthorized disclosure of e-ticket information occurs, subscriber must immediately notify CCBill or the site of said security breach. Subscriber will remain liable for unauthorized use of service until CCBill or the site is notified of the security breach by e-mail or telephone.

12. Sanction and Approval of Adult Material

The owner of this site may be providing material or images intended for an age restricted audience. Access to this site is intended solely for people who are of legal age in the jurisdiction where this site is being viewed and are at least 18 years of age in the US (21 in AL, MS, NE, and WY), who wish to access visual images, audio sounds, and verbal descriptions of a sexually oriented and frankly erotic nature. Materials available within this site may include depictions that are visually graphic in nature and portrayals of nudity or sexual acts and should not be accessed by anyone who is not of legal age in the jurisdiction where this site is being viewed and are at least 18 years of age in the US (21 in AL, MS, NE, and WY), by anyone who finds such material offensive in nature, or by anyone who simply does not wish to be exposed to such materials. Such Terms and Conditions as listed at the site will in no way invalidate any of the Terms and Conditions listed here. All Terms listed apply to CCBill, the site, and the subscriber.
I understand that by having checked the acknowledgement of CCBill?s Terms and Conditions, I am affirming that I have read and understand the terms of this account and authorize CCBill to bill my chosen payment method in accordance with the current terms and conditions.
This agreement is governed by the laws of the State of Arizona and you hereby irrevocably consent to the exclusive jurisdiction and venue of the courts in Maricopa County, Arizona, U.S.A. in all disputes arising out of or relating to the use of CCBill's services.

14. Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

15. Notice

Notices by the site to subscribers may be given by means of electronic messages through the site, by a general posting on the site, or by conventional mail.

Notices by subscribers may be given by electronic messages, conventional mail, telephone or fax unless otherwise specified in the Agreement. All questions, complaints, or notices regarding the site must be directed to CCBill. All cancellations of service to a site must also be directed to CCBill.

1. How are Affiliate sales tracked?
All subscribers are tracked through cookies. The cookie is set when a potential subscriber is logged
through CCBill?s System after leaving an Affiliate's site. The subscriber?s IP address and current time
stamp are logged and compared after sign up. If the cookie has not expired, then the original Affiliate site
is credited for the sale.

3. What does "Rebilling" mean in the administration defaults?
When “Rebilling” is set to “Y”, the Affiliate will receive their dollar or percent amount of the sale every time
the subscription is re-billed. This will occur until the subscription is cancelled.
If "Rebilling" is set to "N", the Affiliates will receive only their portion from the initial sale that is made. This
means that the dollar or percent amount is paid out one time only.
4. In the Advanced Features section of the Affiliate System, what is "Payment Options"?
Under the Payment Options area of the Affiliate Program, you can set how you want to payout your
affiliates. Select trial for subscriptions that have a trial membership period and then re bill into a recurring
subscription. Select recurring for regular recurring subscriptions with no trial. Trials differ from recurring in
that the trial amount may be different from the re bill amount.
If there is a trial membership, you can select between “Yes” or “No” under the Pay for Trial Text Box.
Clicking “No” means that the Affiliate Program will not pay the Affiliate for the trial. Clicking “Yes” allows
the Affiliate to receive a percent or dollar payment for the trial.
4. If there is no trial membership, you can select between “Yes” or “No” under the “Pay For Initial Sale”
box. Clicking “No” means that the Affiliate Program will not pay the Affiliate for the first subscription.
Clicking “Yes” allows the Affiliate to receive a percent or dollar payment for the first subscription.
Rebills works the same way for trial or subscription. You can select between “Yes” or “No” under the
Rebills Text Box. Clicking “No” means that the Affiliate Program will pay indefinitely, until the subscriber
cancels. Clicking “Yes” allows the Webmaster to set the number of rebills. The Stop After Rebill
Number Text Box allows the Webmaster to enter a number after which the rebill will stop.
5. How can my Affiliates receive credit for all sales on my sub-accounts?
The Affiliate system permits all of the sub-accounts to be "grouped" together and treated as one
account. The advantage of this is that Affiliates would only need to sign up under the main account,
and they would receive credit for subscriptions made at any sub-account site. However, the banners
you create will point to only one URL. If you want several banners pointing to several websites, do not
group your account.
NOTE: Stats will not differentiate between Websites when reporting the subscriptions. This is because
the Affiliate program directs all sales to the same account and will ignore sub-account numbers.
6. Who pays the fees to CCBill and the security deposit
The fees are taken from the Webmaster's portion of the sale. It is up to the Webmaster to split any
CCBill fees with their Affiliates. We do not take any fees from the Affiliates. Webmasters are also
responsible for all security deposits. Our contract is with the Webmaster, not the Affiliates. The Affiliates
are using the software through the Webmaster of the site.
7. Who is responsible for fraudulent charges from a Affiliate?
All refunds or chargebacks associated with Affiliate sales will be deducted from both the Webmaster
and Affiliate accounts, equal to the amount they received for the sale. The Webmaster becomes fully
responsible if a Affiliate quits their account, is removed from our system, or has a negative balance. We
also use a negative database to test for chargebacks and returns.
8. Do you issue checks to the Affiliates?
Yes, through our standard delivery methods.

9. What are the charges for printing checks?
There is no charge to print the check, however, webmasters will be charged for the postage fee to mail
the check.
10. Is there a minimum check amount?
The Affiliate will receive a check once their total equals or exceeds $25.00.
11. How can I be notified when a Affiliate signs up with my site?
Webmasters have a choice whether or not to receive E-mail notification when a new Affiliate signs up.

NOTE: The Webmaster will be responsible for providing all necessary code to the Affiliate.
12. Not all of my banners show up on the banner stats page. How do I resolve this?
The banner stats function will show only those banners being used. This creates a more readable
and understandable page. Verify the path to the banner by copying the URL associated with that
banner and pasting it in an address bar. That banner should be web viewable
13. How do I change my redirect URL?
The Redirect URL can be changed by editing the information in the System Setup area.
Login into the CCBill Webmaster Admin System and click the Affiliates link. Click the Setup Tab and
then the System Setup link. Enter the new Redirect URL on the page. Click on Update Button to
save the information.
14. How do I change my refresh URL?
Login to the CCBill Webmaster Admin System and click the Affiliates link.
Click the Setup Tab and then the Advanced Features link. Click the Enable link next to Signup
Refreshing. Enter the new Refresh URL on the page. Click on Submit Button to save the
information.
15. Where do Affiliates obtain the HTML code to put on their page?
After your Affiliates receive an account number, then they can obtain the HTML code for the page by
logging into the Affiliate Administration System and clicking the Get Banners/HTML link. The
following is an example of the code:


16. What is the difference between a single URL redirect and multiple URL redirects?
A single URL redirect routes banner click surfers to the same site or sub-account. Multiple URL
redirects routes banner click surfers to different sites or sub-accounts. All URL redirects require
code written for the banner redirect process.
Webmasters can choose to use single or multiple URL redirects when redirecting surfers from an
Affiliate?s page. If you choose a single URL redirect then the URL specified on the Redirect URL
Page found under the System Setup area will be used for all traffic through the Affiliate Program. If
you choose multiple URL redirects, then you will be responsible for giving the “HTML=URL” portion
of the QUERY_STRING to all Affiliates that sign up, as the system does not include that any more.
This can be used with the refresh URL option to create a more custom program on your end.
If you use multiple URL redirects and a subscriber comes through with no “HTML=” in the query
string, then the single URL redirect will be used so they get to your site either way.
17. If I have multiple accounts, do my Affiliates have to sign up multiple times?
The system default sets your sub-accounts grouped together so that a Affiliate only has to sign up
once. You can group your CCBill sub-accounts together so that Affiliates only have to sign up once
in order to refer traffic to any/ all of your sub-accounts. However if you decide to set up different
Affiliate programs for your various sub-accounts then the Affiliates will have to sign up for each one.
As long as you are using only one Affiliate program, your Affiliates will only have to sign up once.
18. What does "Allow Webmaster to View Address" in the Affiliate signup form mean?
The option to "allow Web masters to view your address" gives Affiliates privacy so the Webmaster
cannot see their mailing address. Web masters will always have access to affiliate E-mail
addresses. If you want to make sure this is the only way they contact you select this option. They
will not be able to view your mailing address when they look up your Affiliate information.
19. Does Quickstats show all of the money I have made?
Quickstats will show an overall total of members, but will only show the dollar amount that you have
made for that day. To see all of your transactions, you must go to transaction reports.
